Please read these terms carefully before using Daily Little. They govern your use of our website and app.
Welcome to Monkey Skates ("Company", "we", "our", "us"). These Terms of Service ("Terms") govern your use of the Daily Little website and the Daily Little mobile app (together, the "Service"), operated by Monkey Skates. Our Privacy Policy also governs your use of the Service and explains how we collect, safeguard and disclose information that results from your use of our web pages and app.
Your agreement with us includes these Terms and our Privacy Policy ("Agreements"). You acknowledge that you have read and understood the Agreements, and agree to be bound by them. If you do not agree with (or cannot comply with) the Agreements, then you may not use the Service.
By using our Service, you may agree to subscribe to newsletters, marketing or promotional materials and other information we may send. However, you may opt out of receiving any, or all, of these communications from us by following the unsubscribe link or by emailing us.
If you wish to purchase any product or service made available through the Service ("Purchase"), you may be asked to supply certain information relevant to your Purchase. You represent and warrant that you have the legal right to use any payment method in connection with any Purchase. The Service may employ third-party services (such as the Apple App Store) for the purpose of facilitating payment and completing Purchases.
Some parts of the Service may be billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring, periodic basis ("Billing Cycle"). At the end of each Billing Cycle, your Subscription will automatically renew under the exact same conditions unless you cancel it or we cancel it. You may cancel your Subscription renewal through your account settings or by contacting the app store where you purchased it.
We may, at our sole discretion, offer a Subscription with a free trial for a limited period. You may be required to enter your billing information to sign up for the free trial. If you do not cancel before the trial ends, you will be automatically charged for the applicable Subscription. We reserve the right to modify or cancel free trial offers at any time without notice.
We may, at our sole discretion and at any time, modify the Subscription fees. Any change will become effective at the end of the then-current Billing Cycle. We will provide you with reasonable prior notice of any change to give you an opportunity to terminate your Subscription before it becomes effective. Your continued use of the Service after a fee change constitutes your agreement to pay the modified amount.
Except when required by law, paid Subscription fees are non-refundable. Refund requests for purchases made through an app store are handled according to that store's refund policy.
Our Service allows you to create, store and share content, including journal entries, notes and photos ("Content"). You are responsible for the Content that you create, and for its legality, reliability and appropriateness.
By creating Content on or through the Service, you retain any and all of your rights to that Content and you remain responsible for it. Your Content is yours; we do not claim ownership of it. You grant us a limited license to store and process your Content solely for the purpose of operating and providing the Service to you.
You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service:
The Service is intended only for access and use by individuals at least eighteen (18) years old. By using the Service, you warrant and represent that you are at least eighteen years of age and have full authority to enter into these Terms.
When you create an account with us, you guarantee that the information you provide is accurate, complete, and current at all times. You are responsible for maintaining the confidentiality of your account and password, and for restricting access to your device. You agree to accept responsibility for any and all activities that occur under your account.
The Service and its original content (excluding Content provided by users), features and functionality are and will remain the exclusive property of Monkey Skates and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks may not be used in connection with any product or service without our prior written consent.
We respect the intellectual property rights of others. It is our policy to respond to any claim that Content posted on the Service infringes on the copyright or other intellectual property rights of any person. If you believe your work has been copied in a way that constitutes copyright infringement, please contact us with the details required for a valid claim.
You may provide us with information and feedback concerning errors, suggestions for improvements, ideas, and other matters related to our Service ("Feedback"). You acknowledge that we may freely use, copy, disclose, and exploit such Feedback without any payment or attribution to you.
Our Service may contain links to third-party web sites or services that are not owned or controlled by Monkey Skates. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party web sites or services. We strongly advise you to read the terms and privacy policies of any third-party web sites that you visit.
The Service is provided by us on an "AS IS" and "AS AVAILABLE" basis. We make no representations or warranties of any kind, express or implied, as to the operation of the Service, or the information, content or materials included therein. You expressly agree that your use of the Service is at your sole risk.
Except as prohibited by law, you will hold us and our officers, directors, employees, and agents harmless for any indirect, punitive, special, incidental, or consequential damage, however it arises. To the extent permitted by law, our total liability to you for any claim arising out of these Terms or the Service is limited to the amount you paid us, if any, in the twelve months prior to the claim.
We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including a breach of these Terms. If you wish to terminate your account, you may simply discontinue using the Service or contact us to request deletion.
These Terms will be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
